Terms of Use
1. Purpose
YouPrompt (the “Platform”) connects creators of AI prompts (“Sellers”) with users who want to acquire them (“Buyers”). YouPrompt sells the prompts to Buyers in its own name, under the license each Seller grants it by publishing, and owes the Seller a royalty on each sale in return. Sellers remain solely responsible for the content of their prompts.
2. Intellectual property in prompts
Each published prompt remains the exclusive intellectual property of its Seller. Publishing on YouPrompt does not transfer any ownership rights to the Platform or to Buyers: the Seller only grants YouPrompt a non-exclusive right to sell licenses to use their prompt.
3. License granted to the Buyer
Purchasing a prompt gives the Buyer a personal or professional, non-exclusive and non-transferable license of use, allowing them to use the prompt to generate content with the AI tools of their choice, including in a commercial context (content generated with the prompt belongs to the Buyer).
This license in no case allows the Buyer to:
- resell, sublicense or redistribute the prompt (as is or slightly modified), on YouPrompt or on any other website, marketplace, social network or medium;
- publicly publish the full text of the prompt;
- share the prompt with third parties outside of personal use or use within their own organization.
4. Traceability and detection of violations
The text of each prompt delivered after purchase includes an invisible digital identifier unique to the buyer (watermark). If a prompt is found resold or republished in breach of the license above, YouPrompt is able to identify the original purchase from that text. YouPrompt also operates an automated system that detects similarity between prompts published on the Platform, to prevent the republication of copied content.
5. Penalties for violations
Any established violation of the license of use (resale, republication, unauthorized sharing) may result, at YouPrompt's sole discretion and without refund, in: removal of the content concerned, immediate suspension or closure of the offending Buyer's account, and/or legal action brought by the injured Seller or by YouPrompt for the harm suffered.
6. Reporting a violation
A Seller who finds their prompt resold or republished without authorization (on YouPrompt or elsewhere) can report it using the “Report this prompt” button on the relevant listing, or write to team@youprom.pt with the URL or the disputed text, which may be analyzed to identify its origin.
7. Seller obligations
The Seller warrants that they are the author of, or hold the necessary rights to, each prompt they publish. Content that is illegal, misleading, or aimed at circumventing AI providers' usage rules (e.g. “jailbreak” attempts) is prohibited and automatically filtered, subject to after-the-fact moderation.
8. Payment and remuneration
The Seller sets the price of their prompt (from €1.99 to €99.99). The Buyer pays this price, plus a service fee of 20% of that price (€0.99 minimum); the price displayed to the Buyer includes this fee. Payment is collected by YouPrompt through Stripe.
On each sale, YouPrompt owes the Seller a royalty equal to the price they set. It is payable on the 1st of each month, for sales more than 14 days old, as soon as the total owed reaches €20 (otherwise it is carried over to the following month).
For a new Seller, this period is 30 days and each payout is capped at €200 (the surplus is carried over to the following month). These conditions apply until they have 4 months of seniority since their first sale and at least 5 different buyers, and again for 4 months after a payment dispute.
A disputed or refunded sale does not give rise to any royalty. If the royalty has already been paid out, YouPrompt recovers it from the Seller's payment account or deducts it from their subsequent payouts. In the event of a dispute or suspected fraud, YouPrompt may suspend all of the Seller's payouts while it checks.
To receive their royalties, the Seller must have their identity and bank details verified by Stripe, YouPrompt's payment partner. No payout is possible without this verification. The Seller is solely responsible for their reporting and tax obligations.
9. Refunds
A prompt is digital content delivered immediately: once unlocked, it has been seen and cannot be returned. Every sale is therefore final and no refund is granted, including if the result obtained is not satisfactory. Before paying, the Buyer expressly requests immediate access and waives their right of withdrawal (article L221-28 of the French Consumer Code). The Buyer has the excerpt, the example output and the reviews to help them decide.
Only the guarantees required by law remain reserved (missing content, or content clearly different from its description): write to team@youprom.pt.
10. Liability
YouPrompt does not guarantee the results obtained by using a prompt with a third-party AI tool, nor the availability or terms of use of such third-party tools. YouPrompt cannot be held liable for content generated by Buyers from the prompts they purchased.
11. Governing law
These terms are governed by French law. Any dispute, failing amicable resolution, falls within the jurisdiction of the competent courts.
